Safety tip: When are you allowed to shoot ?
During 2015 AfriForum addressed more than 160 communities about community safety. The question that most people asked was: “When am I allowed to shoot?”
I went on to try and find a short, good answer that best describes when one is allowed to shoot. It is important for people to realise that they have a responsibility to defend themselves and even others. However, this must be done according to the law.
What are the legal requirements for a person’s actions to be viewed as self-defence?
The attack on you must be illegal.
The attack must be threatening and ongoing when you react.
You cannot act when then the attack is already over.
The self-defence may only be directed at the attacker.
The self-defence action must be relative to the circumstances of the attack. It is also important to take the weapon used against you into consideration as well as the value of the belongings you’re protecting.
The first question you have to ask yourself is: What would a reasonable person do in this situation? This is also the first question the court will ask.
Lastly, remember that when someone is killed, there will be an investigation. This does not mean authorities think you are necessarily in the wrong or guilty of murder. If you were acting in self-defence, you have nothing to fear.
